RETURN POLICY

REFUND POLICY
Retainer fees are final and non-refundable unless cancelled by Kobault Films. All other sales are final and no refunds will be issued.
If you have problems with your delivered product, please contact Kobault Films so that we may work together to find an amicable solution.
House Rules
Kobault Films is limited by the guidelines of the venue and event officials and/or management. Client agrees to accept the technical results of their imposition on Kobault Films. Negotiation with the officials for moderation of guidelines is the Client's responsibility; Kobault Films will offer technical recommendations only.
Retainer and Cancellation Policy
The retainer paid at the signing of the contract is non-refundable. If the Client cancels the terms of this contract more than 30 days prior to the event date, the remaining charges will not be owed and all payments already made above the security deposits will be refunded less material charges incurred up to time of cancellation. If the Client cancels less than 30 days prior to event date, all payments agreed upon in this contract will still be owed to Kobault Films by the Client, unless otherwise discussed.
Pre-event Consultation/Confirmation
The parties agree to a pre-event consultation/confirmation (by phone, email, or in person) at least 7 days before the event or project date in order to finalize the actual capture times, locations, Client request list, and confirmed timeline for the day.
Image/Shot Requests
Due to the unpredictable and uncontrollable nature of weddings, events, and people, Kobault Films can make NO guarantees regarding the delivery of any specific media, though Kobault Films and its representatives will make every reasonable effort to meet the desires of the Client. To that end, if specific content is requested, the Client must provide Kobault Films with a written list of people, groupings, subjects, or shots that they feel are most important to them and allow for assistance in coordinating those shots to happen on the day of capture. It is the sole responsibility of the Client to point out specific people, groupings, subjects, or shots to Kobault Films representatives. Kobault Films shall not be held liable or responsible for any persons present at the event that were not digitally captured.
Exhibition and Promotion/Model Release
Client grants Kobault Films to, without restriction, use, re-use, publish and re-publish content captured during the fulfillment of this contract, in whole or in part, separately or in conjunction with other videos, in any medium now or hereafter known, and for any purpose whatsoever, including (but not by way of limitation) illustration, promotion, advertising and trade. Client forfeits all claims to profits that arise from such use of videos. As a courtesy, Kobault Films will make every reasonable effort to contact the Client in the event that their videos are to be sold for profit or licensed, and the Client will be granted the right of refusal; however, if the Client is not able to be reached, this clause will serve as the full model release of all images as stated above.Copyright
Kobault Films retains full ownership of all original media captured. This includes raw video files, unedited clips, and any other media recorded. The Client acknowledges that Kobault Films holds the copyright to this footage.
Licensing
The Client is granted a non-exclusive, perpetual, worldwide license to use the final delivered media for the purposes specified in the invoice. These purposes typically include promotional use, social media sharing, and personal use. The license allows the Client to showcase the video on their website, social media channels, and other relevant platforms. Kobault Films reserves the exclusive right to license all media captured. The Client may not sell, sublicense, or transfer the video to third parties without explicit written consent from Kobault Films.
Any additional uses beyond those specified in the invoice require a separate agreement or negotiation. The compensation received by Kobault Films (as outlined in the agreement) covers both the services and the licensing rights granted to the Client.
No additional fees are required for the standard usage outlined in the invoice. The Client indemnifies the Videographer against any claims related to copyright infringement arising from their use of the video.
Completion Schedule
Completion schedules vary based on subject and Client order and request. The completion timeline will be followed as noted in the invoice issued by Kobault Films per order.
Retainer
A signed contract and non-refundable retainer fee of $250.00 are required to reserve the specified coverage and date. The retainer fee is applied towards the total amount due.
Payment Schedule
$250.00 of total initial package cost is due at time of signing this agreement and serves as the non-refundable retainer fee. Balance payable in full is due at least one week prior to the capture date unless an alternate schedule is agreed upon in writing by Kobault Films and the Client. Services will not be performed unless payment is received in full. In the event of a late payment, AFTER the capture date, processing of media will not occur until payment is received. Exceptions are made for businesses that issue purchase orders.
Limit of Liability
Kobault Films warrants and declares that every effort will be made to provide high quality media services. In the unlikely event that the Kobault Films representative is injured or becomes too incapacitated to capture the event, Kobault Films will make every reasonable effort to secure replacement coverage. In such an event, Client releases Kobault Films from all terms of this contract and all payments received will be returned. If the situation should occur that a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event. Kobault Films takes utmost care with respect to capture, transportation, and processing of digital media. However, in the unlikely event that media files have been lost, stolen, or destroyed for reasons within or beyond Kobault Films’ control, the Company’s liability is limited to the prorated amount of the clips lost based on the percentage of total number of originals captured. In the unlikely event that a mechanical failure should occur to Kobault Films' equipment and we are unable to provide the Client with the agreed upon services and/or products, responsibility and liability is limited to the return all payments received for the event. Kobault Films and the
Client agree that the Company is not responsible for any other damages, emotional or otherwise.
Rescheduled Event Dates
If the Client’s original event date is postponed, Kobault Films is committed to working with the Client to make the rescheduling process as smooth as possible. Kobault Films will provide the Client with updated booked dates as often as requested. If the new event date is set for a date on which Kobault Films is already booked by another client, the retainer fee already paid by the Client for the original date will be forfeited by the Client. If the new date is set for a date on which Kobault Films is available, the Client will have priority to book the new date and the retainer fee paid for the original date will apply towards the new total.
Deposit Schedule and Bounced Checks
Kobault Films makes regular weekly deposits of client checks. However, occasionally there are delays that could cause a check to be deposited up to two weeks after the Client has written it. If there’s a possibility of insufficient funds in the case of a delay, it’s the Client’s responsibility to ask Kobault Films for notification prior to the deposit of their check. If a Client check is returned for insufficient funds, all work is halted until payment is made in full.
Acceptable Payment Types
Kobault Films accepts personal or business checks, cash, or money order. Checks should be made payable to Kobault Films. A mailing address will be made available upon request.Kobault Films also accepts online payments for an additional 5% fee. These payments may be made through the third-party online payment system accessible through the digital invoice and the Client Hub.
Travel Fees
Kobault Films reserves the right to charge the Client travel fees that will be discussed with the client and applied when deemed applicable, based on, but not limited to charges incurred while traveling to the capture location (such as hotel, airfare, rental car, gas, meals, supplies, etc), and appropriate compensation for time spent by Kobault Films representatives traveling to the location. Travel above 60 miles round trip will be subject to government mileage rate of 67 cents per mile above 60 miles. Travel will be considered by Kobault Films prior to releasing invoice to client. Should travel fees be necessary, an estimate of travel costs will be provided with original invoice. Travel fees will be billed separately and are non-refundable. Travel fees aren't due until 6 months before project date. Travel will not be booked until travel fees are paid in full by Client and as such, the Client is encouraged to pay in full without delay.Style
Client has spent a satisfactory amount of time reviewing Kobault Films' work and has a reasonable expectation that Kobault Films will perform the services in a similar manner and style unless otherwise specified. Kobault Films will use reasonable efforts to ensure the Client's desired services are produced in a style and manner consistent with Kobault Films' current portfolio and Kobault Films will try to incorporate any reasonable suggestion made by the Client. However, Client understands and agrees that:
1. Every client and event is different, with different tastes, budgets, and needs;
2. Digital media services are often subjective art and Kobault Films has a unique vision, with an ever-evolving style and technique;
3. Kobault Films will use its artistic judgement when providing services for the Client, which may not include strict adherence to the Client's suggestions;
4. Although Kobault Films will use reasonable efforts to incorporate the Client's suggestions and desires when providing the Client with digital media services, Kobault Films shall have final say regarding the aesthetic judgement and artistic quality of the services;
5. Dissatisfaction with Kobault Films' aesthetic judgment or artistic ability are not valid reasons for termination of this Agreement or request of any monies returned.
Provisions
By continuing to work with Kobault Films, all parties have read these Terms and Conditions, understand its terms, and agree to be bound thereby. Any additions, deletions, or revisions must be made in writing and approved by all responsible parties. The parties agree that this contract is the complete and exclusive statement of the mutual understanding of the parties.
